A WHS Safety Management System for Transport

Work health and safety law applies to transport businesses as it does to any other employer. For heavy vehicle operators it runs alongside the HVNL, and a WHS safety management system needs to account for both.

What WHS Law Asks of a Transport Business

Under the model WHS laws, a person conducting a business or undertaking (PCBU) has a primary duty of care for the health and safety of workers and others affected by its work. Officers must exercise due diligence to make sure the PCBU complies, and workers carry duties of their own.

Safe Work Australia notes the model laws are in force in every jurisdiction except Victoria. Western Australia's version is the Work Health and Safety Act 2020, and WorkSafe WA administers fatigue rules for commercial vehicle drivers under the WHS (General) Regulations 2022.

A WHS safety management system is how a business organises those duties: policies, risk assessments, consultation, training, incident handling and review.

WHS Duties in a Transport Business

WHS law spreads duties across the business, and each one has a transport version.

The PCBU

The business must ensure, so far as is reasonably practicable, the health and safety of its workers, from drivers on the road to staff in the yard.

Officers

Directors and senior managers must exercise due diligence so the business meets its WHS duties.

Workers

Drivers and other workers must take reasonable care for their own health and safety and that of others, and follow reasonable instructions.

Consultation

Businesses must consult workers on health and safety matters that affect them, and drivers often know a route's hazards best.

The HVNL alongside

For heavy vehicle work, the HVNL adds a primary duty on every party in the chain, aimed at public road safety. The NHVR describes the overlap with WHS as potentially substantial.

Building a WHS System Around Drivers

Driving is one of the main work activities in a transport business, so it deserves its own place in the WHS system.

Fatigue

Set work and rest arrangements, and record them, so tired drivers stay off the road. In WA this is a specific WHS requirement for commercial drivers.

Fitness and impairment

Ask drivers to declare fitness at the start of each shift, and give them a safe way to say they can't drive.

The vehicle

Pre-start checks and defect reporting manage the risks of the cab and the vehicle itself.

Hazards on the job

Give drivers a quick way to report hazards at delivery sites, depots and on the road.

Incidents

Record incidents and near misses, investigate them and act on what you find.

Training and inductions

Keep training and site induction records current, with alerts before they expire.

Electronic Work Diary vs Paper Logbook

Fatigue records are the part of a WHS system that heavy vehicle work adds. This is how an electronic diary compares with the paper version.
Electronic Work Diary
Paper Logbook
One minute accuracy
Fifteen minute blocks
Automatic syncing
Manual entries
Easy to read and access
Handwriting varies
Real time operator visibility
No live oversight
Secure cloud storage
Can be lost or damaged
Faster audits and reporting
Time consuming
Accurate hours records help show that your WHS fatigue controls are actually being used.

How It Works

A practical sequence for putting a WHS safety management system in place in a transport business.
Step 1

Commit and resource

Officers set the policy, assign responsibilities and give the system the time and money it needs.
Step 2

Consult your drivers

Ask drivers and yard staff where the risks are before writing any procedures.
Step 3

Assess the risks

Work through driving, loading, yard work and site visits, and choose controls for each.
Step 4

Write it down simply

Record procedures in plain language that drivers will actually read.
Step 5

Record the controls

Set up checks, declarations and reports so there's evidence each control happens.
Step 6

Keep improving

Look at incidents, alerts and feedback regularly and update the system to match.

Ray A.

First day with Logmaster was to my surprise was user friendly. Josh was very thorough in taking me through all the steps in setting up the Logmaster app. I would recommend Logmaster to all drivers regardless of age. Never have to worry about making a mistake as it tells you if you are. Great customer service after hours support is second to none.

Mike H.

Have started using Logmaster after trying 3 other models. I actually enjoy using it. Very easy to use and follow and the help if you need it is top notch by the developer. Does everything by the minute and works when no service is available. My system is customised for me and fits well with my system (I’m WA). Cost is on par with two of the other ones looked at.
