NHVR Fatigue Management: What the Regulator Expects

The National Heavy Vehicle Regulator sets the tone for fatigue compliance in the states and territories that run under the HVNL. Knowing how it checks and grades breaches helps you keep records it can rely on.

The NHVR's Part in Fatigue Management

The NHVR administers and enforces the Heavy Vehicle National Law in the ACT, New South Wales, Queensland, South Australia, Tasmania and Victoria. Western Australia and the Northern Territory sit outside the HVNL and run their own rules.

On fatigue, the regulator does four main jobs. It publishes the work and rest options, it approves electronic work diaries and lists them, it runs the accreditation scheme for alternative hours, and its Safety and Compliance Officers check drivers and records on the road and at the depot.

In Queensland and New South Wales, the NHVR has taken over on-road heavy vehicle compliance from the state transport agencies, so its officers now run on-road heavy vehicle checks there too.

What an NHVR Officer Looks For

At a roadside check, the officer wants to see that the driver's record is complete and that their hours add up.

A diary that matches the trip

The work diary or EWD should show work and rest that fits where the vehicle is and when it got there.
Less paperwork icon

Rest taken as rest

Breaks need to meet the minimum length and, for the longer rests, be taken while the vehicle is stationary.

The right hours option

The diary should show the option the driver is working under, plus the accreditation number where alternative hours apply.

A driver fit to continue

Officers can stop a driver from driving if they reasonably believe the driver is impaired by fatigue or unfit to drive.

Readable entries

An EWD record is clear on screen, which avoids disputes over smudged times on a carbon copy.

How Breaches Are Graded

The HVNL grades risk breaches in four categories, and the critical category is used only for fatigue breaches.

Minor risk

The lowest category, used for smaller overruns or shortfalls against the work and rest limits.

Substantial risk

A larger shortfall in rest or overrun in work, carrying a higher penalty than a minor breach.

Severe risk

A serious departure from the limits, where the danger to the driver and other road users is plainly higher.

Critical risk

The top category, reserved for fatigue, where the gap between the limit and what happened is greatest.

Fines at the roadside

Infringement amounts are set at 10% of the maximum court-imposed penalty, and courts don't automatically impose the maximum.

Beyond the driver

Investigations can extend to the operator and other parties in the chain if business practices contributed to the breach.

Electronic Work Diary vs Paper Logbook

How an officer's check of an electronic diary compares with a paper one.
Electronic Work Diary
Paper Logbook
One minute accuracy
Fifteen minute blocks
Automatic syncing
Manual entries
Easy to read and access
Handwriting varies
Real time operator visibility
No live oversight
Secure cloud storage
Can be lost or damaged
Faster audits and reporting
Time consuming
Officers accept both. With an NHVR approved EWD, the entries are already totalled and legible when the officer asks.

How It Works

Preparing your business for the way the NHVR checks fatigue comes down to a few habits.
Step 1

Confirm each driver's option

Make sure every driver knows whether they work under Standard Hours, an existing BFM or AFM accreditation, ACA-Fatigue or an exemption.
Step 2

Carry what's required

Drivers on accreditation hours carry a copy of the operator's certificate and record its number.
Step 3

Keep diaries current

Entries should be made as work and rest change, not filled in at the end of the day.
Step 4

Check records daily

A record keeper who reviews hours each day catches problems before an officer does.
Step 5

Hold records for three years

Fatigue records must be kept for at least three years after they're made or received.
Step 6

Respond to notices

If a breach is detected, review the roster and the reasons behind it, not only the driver's entry.

Why Operators Use Logmaster for NHVR Checks

Logmaster is on the NHVR's list of approved electronic work diaries and records work and rest to the minute against each driver's plan. The office sees potential breaches as they arise, and records are held in the cloud for the three-year retention period. Over 10,000 drivers keep their diaries in it.

Ray A.

First day with Logmaster was to my surprise was user friendly. Josh was very thorough in taking me through all the steps in setting up the Logmaster app. I would recommend Logmaster to all drivers regardless of age. Never have to worry about making a mistake as it tells you if you are. Great customer service after hours support is second to none.

Mike H.

Have started using Logmaster after trying 3 other models. I actually enjoy using it. Very easy to use and follow and the help if you need it is top notch by the developer. Does everything by the minute and works when no service is available. My system is customised for me and fits well with my system (I’m WA). Cost is on par with two of the other ones looked at.
